who pays for mediation?

the most common approach is for parties to equally split the cost of mediation unless they are able to negotiate different arrangements in the course of mediating. however, this is not the only way that payment arrangements can be made.

i have experienced circumstances where one party covers the full mediation cost, often to encouage others to participate or to overcome affordability-related delays. on some occasions, a third party with an interest in the conflict getting resolved will pay for the mediation.

if mediation is required pursuant to the terms of an agreement or a governing document, guidance may be offered around this there.
